Usage of Donation

1. Statement of Legal Declaration (Donations)

By making a donation to Foundation for Resilience Actions (“Foundation”), the donor acknowledges and agrees as follows:

  1. The donation is made voluntarily, without any coercion or undue influence, to support the charitable objects and programs of the Foundation, including but not limited to water, sanitation, hygiene (WASH), climate resilience, community development, sustainability initiatives, infrastructure support, and awareness programs.
  2. The donor understands and agrees that contributions may be pooled into a general-purpose fund and utilized at the sole discretion of the Foundation in accordance with its governance framework and priority areas of intervention.
  3. Illustrative uses of donations may include development of water infrastructure, sanitation facilities, community-based interventions, mangrove and seagrass afforestation and restoration, restoration of waterbodies, awareness campaigns, resilience-building initiatives, and other social impact programs. Such examples are indicative in nature and do not constitute any specific commitment or earmarking of funds.
  4. The Foundation shall allocate resources to geographies and beneficiaries based on assessed needs and impact considerations.
  5. The donor confirms that the funds contributed are from legitimate sources and in compliance with applicable laws.
  6. Eligible donations shall qualify for tax exemption under applicable provisions of the Income-tax Act, 1961 (including Section 80G, subject to statutory compliance). The donor agrees to provide requisite details such as PAN and address for issuance of tax
    certificates.
  7. Donations once made are non-refundable, except in cases of genuine error, and any approved refund shall be subject to deduction of applicable transaction charges and administrative costs.
  8. The donor may opt to receive updates and communications from the Foundation and may withdraw such consent at any time.

2. Donor Data Protection & Privacy Policy (DPDP Compliant)

(Compliant with Digital Personal Data Protection Act, 2023)
Foundation for Resilience Actions (“Resilience Actions” or “RA”) is committed to safeguarding personal data and ensuring compliance with the Digital Personal Data
Protection Act, 2023 (“DPDP Act”).

1. Collection of Personal Data

The Foundation collects personal data solely for lawful purposes connected with its activities, including:
Name, address, email ID, phone number, PAN (where required), donation details, transaction data, and any other information voluntarily provided by the donor (“Donor Data”).

2. Purpose of Processing

Donor Data is processed strictly for legitimate and specified purposes, including:
Processing donations and issuing receipts (including tax exemption certificates), donor communication and acknowledgements, compliance with legal and regulatory requirements, internal record-keeping and analytics, and informing donors about the Foundation’s
initiatives (subject to consent).

3. Consent

By providing personal data, the donor provides free, specific, informed, and unambiguous consent for its processing. The donor has the right to withdraw consent at any time, subject to legal or contractual limitations.

4. Data Sharing

The Foundation does not sell, trade, or rent personal data.
Personal data may be shared only:
       i. with authorized service providers (such as payment gateways, IT service providers) under strict confidentiality obligations; or
      ii. where required under applicable law or by statutory authorities.

5. Data Minimization and Retention

Only necessary data is collected and retained for as long as required for the stated purpose or as mandated under applicable laws (including tax regulations), after which it is securely deleted or anonymized.

6. Data Security

RA implements reasonable technical and organizational safeguards to protect personal data from unauthorized access, disclosure, alteration, or destruction.

7. Rights of Donors

In accordance with the DPDP Act, donors have the right to:
       i. access their personal data,
       ii. request correction or updating of inaccurate data,

      iii. withdraw consent,
      iv. request erasure (subject to legal obligations), and
      v. seek grievance redressal.

The Foundation shall address grievances within a reasonable timeframe in accordance with applicable law.

9. Children’s Data

The Foundation does not knowingly collect personal data from children without verifiable parental or guardian consent.

This Policy may be updated from time to time. Updated versions shall be made available on the Foundation’s website.
